Mazi Nnamdi Kanu’s legal team has released a six-point list of demands ahead of their client’s arraignment in court on Thursday 21st of October signed by Ifeanyi Ejiofor, Esq., the Lead Counsel to Onyendu Mazi Nnamdi Kanu/IPOB.

Mazi Nnamdi Kanu was unlawfully arrested in Kenya on the 19th Day of June 2021 and has been under the detention of the Department of State Security Services (DSS). He was secretly arraigned in court on the 29th of June 2021 then on the 26th of June when he was expected to appear fully, the department refused to present him to the court.

The federal government has presented an amended seven-count charge against Mazi Kanu on Friday, 15th October 2021.

Count one:

That you Nnamdi Kanu, male adult of Afaraukwu lbeku Umahia North Local Government Area of Abia State being the leader of the Indigenous People of Biafra (IPOB) on diverse dates in 2014 and 2015 in London, United Kingdom, did broadcast on Radio Biafra monitored in Enugu and other areas within the jurisdiction of this Honourable Court, preparations made by you and others now at large for states in the South-East and South-South zones and other communities in Kogi and Benue States to secede from the Federal Republic of Nigeria with a view to constituting same into the Republic of Biafra and you thereby committed an offence punishable under Section 41(c) of the Criminal Code Act, CAP. C77, Laws of the Federation of Nigeria, 2004.

Count two:

That you Nnamdi Kanu, male, adult, of Afaraukwu Ibeku, Umuahia North Local Government Area of Abia State, on or about the 28th April 2015 in London, United Kingdom did broadcast on Radio Biafra monitored in Enugu, Enugu State and other parts of Nigeria within the jurisdiction of this Honourable Court, referred to Major General Muhammadu Buhari, GCON, the President and Commander-in-Chief of the Armed Forces of the Federal Republic of Nigeria as a paedophile, a terrorist, an idiot and an embodiment of evil, knowing same to be false and you thereby committed an offence contrary to Section 375 of the Criminal Code Act, Cap C. 77, Laws of the Federation of Nigeria 2004.

Count Three:

That you Nnamdi Kanu, male adult of Afaraukwu lbeku Umahia North Local Government Area of Abia State between the month of March and April 2015 imported into Nigeria and kept in Ubulusiuzor in Ihiala Local Government Area of Anambra state within the jurisdiction of this Honourable Court, a Radio transmitter known as TRAM 50L concealed in a container of a used household which you declared as used household items and you thereby committed an offence contrary to Section 47 (2) of the Criminal Code of Act, Cap C45, Laws of the Federation of Nigeria, 2004.

Count four:

That you Nnamdi Kanu, male, adult. of Afaraukwu iIbeku, Umuahia North Local Government Area of Abia State in London, the United Kingdom between 2018 and 2021 Radio Biafra monitored in Enugu, Enugu State and FCT, Abuja within the jurisdiction of this Honourable Court, professed to be a member of Indigenous People of Biafra (IPOB), a proscribed organisation in Nigeria and you thereby committed an offence punishable under Section 16 Terrorism Prevention Amendment Act, 2013.

Count five:

That you Nnamdi Kanu, male, adult, of Afaraukwu Ibeku, Umuahia North Local Government Area of Abia State on the 22nd of April, 2021 in London, the United Kingdom on Radio Biafra monitored in Enugu, Enugu State and other parts of Nigeria within the jurisdiction of this Honourable Court did an act of terrorism in that you incited the other members (followers) of the Indigenous People of Biafra (IPOB}, a proscribed organisation in Nigeria, to look for security personnel, their family members through a Radio Biafra on 102.1FM monitored through the IPOB Community Radio and you thereby committed an offence contrary to and punishable under Section 1 (2) (h) of the Terrorism Prevention Amendment Act.

Count six:

That you Nnamdi Kanu, male, adult, of Afaraukwu Ibeku, Umuahia North Local Government Area of Abia Stale on the 16thh of May 2021, in London, the United Kingdom within the jurisdiction of this Honourable Court did commit an act in furtherance of an act of terrorism by making a broadcast that “In 2 weeks’ time, what will happen will shake the world, people will die, the whole world will stand still, mark my word” and you thereby committed an offence contrary to and punishable under Section 1 (2) (b) of the Terrorism Prevention Amendment Act, 2013

Count seven:

That you Nnamdi Kanu, male, adult, of Afaraukwu Ibeku, Umuahia North Local Government Area of Abia State on the 31st of May, 2021, in London, the United Kingdom within the jurisdiction of this Honourable Court did an act in furtherance of an act of terrorism by issuing a deadly threat that anyone who flouted your sit-at-home order should “write his/her will,” as a result bank’s, schools, markets, shopping malls, fuel stations were not opened for businesses and vehicular movements grounded and you thereby committed an offence contrary to and punishable under Section 1 (2) (b) of the Terrorism Prevention Amendment Act, 2013.

The lawyers are demanding that their client must appear in court, they want the security operatives sent to the court to carry out their duties professionally. They also reminded the soldiers of the Aba massacre in 2015 and 2016 on innocent citizens who came to support Mazi Kanu. They also said the sit at home, although called off, was on because the people want to know if Kanu was still alive. They warned the security agents against maltreating lawyers representing Kanu and lastly, they are demanding Fairplay and fair hearing from the court.

The six-point demands present by Mazi Nnamdi Kanu’s lawyer:

1. That tomorrow, being the 21st day of October 2021 should be sacrosanct. Our Client – Onyendu Mazi Nnamdi Kanu MUST and SHALL be produced in Court to face his trial. Thankfully, the Learned Director of Public Prosecution of the Federation, has though belatedly filed a 7-Count Amended Charge, along with an affidavit of completion of the investigation, so there is no excuse or place to hide whatsoever again to justify doing the contrary.

2. That Security Agents ostensibly to be deployed to man the Court and its environs, or detailed to provide security on this 21st day of October 2021, should be manifestly civil in their conduct towards the civilian populace who are expected to throng the Court in their numbers in solidarity.

3. We wish to remind the Security Agents that it was in a period such as this in 2015 and 2016 respectively, that citizens who merely came out in their numbers for the show of solidarity with our Client on the day he was brought to Court, were massacred in their numbers at Ngwa National High School Aba, Abia State; Afor Nkpor, Onitsha Head-bridge, and Ziks Avenue in Anambra State.

4. We also wish to state that the current tension and regular Monday sit-at-home being observed by our people in the South East, despite the exercise being called off by our Client’s peaceful movement, is steadily gaining momentum because our people are yet to see and believe that our Client Onyendu Mazi Nnamdi Kanu is still alive.

5. That the Security Agents should avoid any situation that will result in any form of maltreatment to the Lawyers in court (whose constituency is that very court), the media, or those that will be attending Court in solidarity with our Client.

6. We demand justice, fair hearing/trial and fair play, which will not only be done in the open Court but manifestly be seen to have been done by an average person watching from close proximity.
